Estes Park Prohibits Retail Marijuana Establishments
At its regular August 13 meeting, the Estes Park Town Board voted to prohibit retail marijuana establishments within Estes Park town limits, as well as prohibit private marijuana clubs in commercial and industrial establishments. The board considered public comments on both sides of the issue, received before and during the meeting.
Pursuant to requirements of Amendment 64 approved by voters in November of 2012, the Town of Estes Park adopted an ordinance prohibiting marijuana establishments including testing facilities, production facilities and retail stores. Also pursuant to Amendment 64, the Town has amended the municipal code to reflect that it cannot prohibit the possession, use, consumption and non-commercial transfer of one ounce or less of marijuana by individuals ages 21 and older. The code has also been amended to prohibit the open and public use and consumption of marijuana. These changes to the code will take effect 30 days after publication. Amendment 64 requires that local governments choosing to prohibit retail marijuana establishments have those rules in place by October 1, 2013.
